CONDITIONS OF ENTRY - WAIVER AND RISK ACKNOWLEDGEMENT
1. Upon entering Iremia Recovery, you acknowledge and agree to the conditions of entry/terms of access and participation in our recreational activities. Your entry signifies compliance with these conditions and agreements set forth by Iremia Recovery.
2. You acknowledge and agree that:
Upon entering Iremia Recovery, you concur with the below entry terms, under the condition of the reciprocal agreement from Iremia Recovery to permit your access and participation in the Activities.
Your acknowledgment and agreement encompass that: you accept all risks of potential injuries or health issues that could occur from entering Iremia Recovery or participating in the Activities, including but not limited to slipping, temperature extremes, equipment failure, or other patrons’ actions; certain Activities may be inappropriate during pregnancy, and it's your duty to obtain medical guidance and clearance prior to engaging in any Activities while pregnant.
You declare you are free from any existing injuries or health conditions that could be exacerbated by participation; your entry and participation in any Activity at Iremia Recovery is done willingly and at your sole risk; Iremia Recovery, at your expense, may undertake necessary measures for your safety in case of injury or health issues while on the premises, including emergency medical care and ambulance services, without being obligated to do so; any statutory consumer guarantees under the Competition and Consumer Act 2010 (ACL) are waived for issues addressed in section 139A(3).
Should a guarantee be implied, Iremia Recovery's responsibility is limited to re-providing the services. This agreement does not affect your legal rights against reckless conduct causing substantial personal injury as outlined in the ACL.
You consent to: release and indemnify Iremia Recovery and its associates from any claims or liabilities arising from your presence at Iremia Recovery or engagement in Activities; reimburse Iremia Recovery for any expenses resulting from any breach of this agreement.
Definitions within these terms:
"Illness" encompasses any physical or psychological ailment.
"Injury" refers to any physical or psychological harm, including exacerbation, hastening, or reoccurrence of a pre-existing condition.
"Iremia Recovery" refers to Paraha BJJ Pty Ltd and its personnel.
"Activities" includes all offerings at Iremia Recovery, like pool, sauna, cold plunge, compression therapy, and other services.
By entering or participating in Activities, you acknowledge that: you comprehend and agree to these terms; you recognise this as a liability waiver and voluntarily consent to its stipulations; these terms apply regardless of payment status for entry.
General Entry Terms
Compliance with staff instructions is mandatory for safety and enjoyment during Activities. Failure to comply may result in removal from the premises without a refund.
You consent to the potential use of your image in promotional materials unless a written objection is submitted.
You acknowledge the use of security cameras in public areas for safety purposes.
No jumping into the pools is permitted.
You will be respectful of other patrons
You are required to wear swimwear in the pools
You must be 16 years of age to enter the premises and use the facilities. ID must be provided for 16 and 18 years of age as proof of age.
10% service charge applies on QLD public holidays
1.6 transition fee applies for all card payments.
CCTV Surveillance
By entering and using the facilities at Iremia Recovery, you acknowledge and consent to the presence of CCTV cameras on the premises for security and safety purposes. All areas within the bathhouse are monitored, and video recordings may be captured for the purpose of protecting the well-being of patrons, staff, and property. By entering the bathhouse, you agree to be recorded by these surveillance systems.
If you do not wish to be recorded, please refrain from entering the premises.
